TERMS AND CONDITIONS

This Agreement (“Agreement”) is entered between Alive To Enjoy, having its registered office at 4702 281st Ave NE, Redmond WA 98053, through its website alivetoenjoy.com and ‘You’ as the User on the website. The terms such as ‘Company’, ‘Platform’ and ‘Alive To Enjoy’ shall be used in reference to the Platform and the terms such as ‘You’ and ‘User’ shall be used in reference to the User of the website.

NOW, THEREFORE, IN CONSIDERATIONS OF THE PROMISES AND MUTUAL COVENANTS SET FORTH HEREIN, THE PARTIES HERETO, INTENDING TO BE LEGALLY BOUND, HEREBY AGREE AS FOLLOWS:

  1. SCOPE OF SERVICES:

The Platform provides the following Services (the “Services”):

    1. We provide Self-discovery Coaching Services to our Users. These Services are provided both online and in-person (offline). The Self-discovery service includes talking, meditation, breathwork, journaling, some embodiment practices and other holistic healing modalities.

    2. We teach Yoga to our Users. That includes teaching in person, online, in private sessions or groups.

    3. We provide an online course to our Users: We will be offering group coaching with pre-recorded videos.

    4. There might also be few offline events such as yoga retreat, which includes yoga, meditation, journaling and food. 

    5. There might also be Podcasts where we will be inviting guests from around the world.

  2. SUBSCRIPTIONS:

    1. Your Integrated Self is a 3-month coaching session that we will be providing for $2,000. This Subscription is a 3 months package with 6 coaching sessions, 3 private yoga sessions, 2 x 15 minutes meditations, unlimited emailing and voxer messages in between sessions (Weekends not included).

    2. 1 Hour Recenter Yourself Coaching Call is a one-hour coaching session that we will be providing for $222.22. It includes coaching, meditation and breathwork.

    3. Personal Meditation Session is a 30 minutes meditation session that we will be provided for $44.44.

    4. Embody the Magic of You is an online course with live calls, pre-recorded videos and soul work which we will be providing for $1,333

 

  1. PAYMENT TERMS:

    1. For the payment of the coaching program and online course, You can either pay in full or in installation. Installation payment service is available in 2, 3 or 5 parts.

    2. For the payment of the one-hour coaching session, You can either pay in full or in an installation of two parts.

    3. The payment for the online workshops, events or offline classes needs to be done in full.

    4. The payment plan may cost more due to the service charge of the banks or the credit card fees.

    5. We accept Stripe or PayPal as the Payment method. However, in the case of offline events/classes, we accept cash as well.

    6. In case of installation payments, any failure in the Payment will result in immediate termination of the Service offered.

    7. In case You fail to pay for the Subscription for the succeeding sessions, a late fee of  $11.11 will be added every week.

  2. DISCLAIMER:

    1. There is no guarantee that the programs will offer the same results to everyone. We share educational and informational resources that are intended to help you succeed in self-discovery. Your ultimate success or failure will be the result of your efforts, your situation, and other circumstances that are beyond our knowledge and control.

    2. We do not provide healthcare, medical, mental health care or nutritional therapy services or attempting to diagnose, treat, prevent, or cure any physical, mental, or emotional issue. 

    3. The information provided on our Platform is for informational purposes only and is not intended to substitute professional medical advice, diagnoses, or treatment. Always seek advice from your physician or other qualified healthcare providers before undertaking a new health regimen.

    4. We do not take any responsibility for the results of your actions, and any harm or damage You suffer as a result of the use, or non-use of the information available on this Platform or material. We advise You to use judgment and conduct due diligence before taking any action or implementing any plan or practice suggested or recommended Platform or material.

    5. The accuracy of information provided might become out-of-date at some point. Once your materials are sent or handed out, we will not be able to update this information, so Alive To Enjoy bears no responsibility for this.

    6. The User agrees and consents to the following:

      1. I understand that all comments and ideas offered by my Coach are solely to aid me in achieving my defined goals. I can give my informed consent, and hereby give such consent to my coach to assist me in achieving such goals and aims.

      2. I understand that the use of technology is not always secure and I accept the risks of confidentiality in the use of email, text, phone, zoom and other technology.

      3. I understand that coaching is, at present, an unregulated industry and that my Coach is not licensed by any internationally recognised regulator. I also understand that for all legal purposes, the services provided by my Coach will be considered to be provided from any remote location worldwide.

  3. CONDUCT:

The User agrees  not to:

    1. engage in any conduct that is contrary to the laws of the nation, such, but not limited to, its password, login credentials, editing history, or other similar account details, confidential information of other Users gathered.

    2. publicize or conduct business in a way that is wrongful, unfriendly, dark, defamatory, divine, hateful, or promotes illegal activities such as gambling, pornography, money laundering, or any other act, material, or images that are illegal under the laws of the nation.

    3. engage in any conduct that leads in the transmission of unsolicited emails, messages, phone calls, or even posts to other Users, the Company, the Platform, and any other individuals linked with the same, such as representatives, agents, or employees.

    4. engage in marketing advertising, information, instruction, and/or solicitation of activities, items, products, goods, or works derived from the same.

    5. file information solely for false or deceptive purposes, which is illegal.

  2. INTELLECTUAL PROPERTY:

    1. All the trademarks, copyrights, licenses, patents and other intellectual properties are solely owned by the Platform. The User shall under no circumstances, use the intellectual property of the Platform for their personal use without the prior written consent of the Platform.

  3. LIMITED LIABILITY:

7.1. The User acknowledges that the Platform will not be held liable for any problems, including loss of access to, resulting from, or related to the Platform's accessibility.

7.2. The Platform, the Company, and any other person, representatives, or agents associated with, or even employees involved in, the Platform shall not be held liable for any direct, indirect, punitive, special, consequential, or other type of harm originating from or relating to:

  1. GOVERNING LAW:

    1. This Agreement shall be governed under the Laws of the USA and shall be subject to the jurisdiction of the courts of Washington State.

  2. DISPUTE RESOLUTION:

    1. In the event of a dispute, confusion, or difference arising from, out of, or in relation to the terms specified in the Terms and Conditions (hereinafter “Dispute”), the Platform and You (collectively referred to as “Parties”) will make every effort to resolve such Dispute through mediation as soon as possible.

  3. MISCELLANEOUS:

    1. We do not offer any refund after the Subscription is bought. However, we offer refunds only in an emergency situation which will be decided by the Lexy (“Coach”).

    2. There might be some days where the Instructor might not be available due to network problems or emergencies. In such cases, the Instructor might have to reschedule in short notice.

    3. You understand that in order to enhance the coaching relationship, you should communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.

    4. All the sessions will be recorded and will be used for future use.

    5. You will have the option to reschedule or cancel 24 hours in advance via email or Voxer. All late reschedules/cancellations are subject to a fee of 50% of the session cost regardless of the length of the session. There is some flexibility in this policy for emergency situations but remember a scheduled appointment is time reserved especially for You. And usually, if  you cancel at the last minute the reserved spot cannot be rescheduled. Sessions that are "No Show" with no notice of cancellation are charged the full amount of the session. Fees must be paid before another session is scheduled. And once a session is missed, We may request that pre-payment be made prior to the start of any session. If You do not appear for more than twice, the coaching agreement will be terminated. 

  4. UPDATES

10.1 In case there are any updates to the terms and conditions, the Users will be notified through the portal and their consent will be recorded.
